Cater 2 theft?

First a lil history:
Cater 2 U is an R&B song written by Beyoncé Knowles, Kelly Rowland, Michelle Williams, Rodney Jerkins, Ricky "Ric Rude" Lewis, Robert Waller for Destiny's Child's fourth studio Destiny Fulfilled (2004). It was produced by Knowles, Rude and Jerkins and released as the album's fourth and final single in summer 2005, while the song peaked at number 14 on the U.S. Billboard Hot 100. "Cater 2 U" was nominated for two Grammy Awards for Best R&B Song and Best R&B Vocal Performance by a Duo Or Group. It is also the band's last high-charting single.

However interestingly enough only Beyonce is named as being sued.

A copycat claim contained in a 2006 lawsuit is expected to land the "Bootylicious" sensation in a witness chair next month as part of a copyright infringement trial to be held in Chicago's federal courthouse.

A Chicago songwriter copyrighted the song "Cater 2 U" long before Destiny's Child came out with a song by the same name. The songwriter also says the lyrics are similar. (AP)

In dispute is a song titled "Cater 2 U" released by Destiny's Child in a 2004 compilation called "Destiny Fulfilled." The video features sultry scenes of the musical trio proclaiming: "Whatever you desire, I'll aspire."

But Chicago songwriter and performer Rickey Allen says it's his song, and a judge has given the green light for a jury to hear his claims against Mrs. Jay-Z.

Allen first copyrighted his "Cater 2 U," -- with the same spelling -- in the mid-1990s. He performed the song locally and updated the copyright three times, as recently as 2000.

Allen's song is about "relieving the stress of a significant other, and getting them to relax." He says Destiny Child's version contains similar steamy lyrics.

When Allen's song says: "I want to rub you down," Destiny's Child asks: "Want a foot rub?"

Allen's lyrics say: "The tub has hot steam rising," and "I'm waiting to soak your body through."

The Destiny's Child song offers to: "Let me run your bath water."

"Do we say [Beyonce's] responsible for copying? Yes. But there's no such thing as innocent copying, even if it's unintentional," said Allen's lawyer, Matt Wildermuth. "The jury will decide the notion that these are simple coincidences."

Allen says he passed a copy of his "Cater 2 U" to Chicago remixer Maurice Joshua, and the two planned to collaborate on a demo.

That never happened, Allen says. But Joshua later spent several hours in a session with Destiny's Child recording a different song, according to court papers. Joshua says he never had a copy of Allen's work.

Lawyers for the threesome say the case has no merit and asked that it be tossed.

It was Knowles who was the source for the idea of "Cater 2 U," her lawyers said in a court filing.

"She is perhaps the most important witness for the defendants," they said.

U.S. District Judge James Holderman has ruled there's enough evidence for the case to go before a jury, pointing to Joshua as the link and saying it's possible he could have provided a copy of Allen's song before they released their hit. The trial was delayed once because of conflicts with Knowles' schedule but is set for Dec. 10.

Your thoughts on DC Reunion with LeToya


Jamba kindly posted an interview here of LeToya saying that she would be interested in a Destiny's Child reunion in the future. Do you think this would be a good move for LeToya or not? Personally I dont think she should give them the satisfaction of making more money for Mathew and his company. Do they not already have enough? Then, on the flip side it would be amazing to have LeToya, LaTavia and Farrah all doing something on the new album. It would also put Beyonce in a completely new light, that bad taste left by what happened might just disappear.

Aaliyah Vs Beyonce


I have to ask the question... would Beyonce have been as popular now if Aaliyah hadnt have passed away when she did?

Aaliyah was at the top of her career and about to become a global star. Unfortunately, she was taken from us sooner than we wanted...which left a big gap in the market for a beautiful, strong image in the charts...along came Beyonce who was about to break out of her Destiny's Child group and go solo.

No I dont want to be like You!

In an interview with Essence.com, T-Boz responded to the over reacted comment she made about Destiny's Child. Most importantly, T-Boz mentions how no way in hell would she ever participate in a situation like Beyonce and Destiny's Child.

T-BOZ: (Laughs.) I was simply expressing my thoughts on girl groups in general and that my personal choice would never be to put myself in a situation where I'm in a group that is managed by one of the group member's parents. I think that Mathew and Tina have done a great job, so it's no diss to them or not taking away anything from what they've accomplished. I just know what would not work for me, because, at the end of the day, if a manager has a personal relationship with someone in the group they are managing, they are always going to have that person's interest first and foremost and that's all I was expressing.

Solange to replace Beyonce in Destinys Child?

According to one of our label insiders, Beyonce is reluctant to record another album with her former members.The insider told MediaTakeout.com, “I actually agree with Beyonce. Doing an entire album with [Kelly and Michelle] doesn’t really make sense.” The insider added, “She’s at the height of her career right now – why take a step back.”The label insider offered his take on what the new Destiny’s Child album will look like. The tipster told MediaTakeout.com, “The new [album] will either be remixes of old songs - or maybe Solange will be the new lead singer. I know [Mathew Knowles and co.] was floating that idea a while back.”

Destiny's Child Comeback Info



I have it on very good authority and from one of my inhouse snitches that Destiny's Child will be making a comeback after Beyonce has finished her "I Am…." tour. As we know, Kelly Rowland has left MWE and Columbia Records as a Solo artists but is still contracted within the Destiny's Child legacy. I must say, they have worked this very cleverly. Matthew Knowles must know from Beyonce's tour that Beyonce is not earning the way she should be….they only way they will make a nice bumper profit is if the ladies return as a unit. Question is…have they been away too long? Personally, I would love to see the girls get back together but their success is now questionable on many levels. I would laugh if Kelly turned around and said No but Im sure she cant afford not to. Its all so fake! What would be really hot is if LeToya and LaTavia joined them…. Everyone would be interested then. Lets hope Solange doesn’t trail behind them… little parasite.

OKay..... so if Destinys Child get back together after all this ish I will eat my Jimmy Choos y'all... the relationship is severed. I really hope Kelly blows up on her new project.... I cannot wait to see what she brings. Step out of that shadow girl.... I just hope she hasnt left it too late

Poll Results: Best Album From DC


You voted and decided that "Writings On The Wall" was the best album to be released by Destiny's Child. The album was surrounded with controversy with members being removed and added. It was also one of my personal favourites. Nearly EVERY song was a hit!
